Forgive me for being the eternal skeptic, but I would not be the least surprised if some time later, he and his wife are arrested for attempted extortion by posting pics from the phone, then leaving it behind for some poor Mic Dee's employee to find. They probably did this as a way to finance a new home, if you ask me...
Moral of the story, do not store 'personal' pictures in your phone. But then again, it might be what ralphrepo said though.

oh damn thats embarrassing... all his staffmembers + ppl on the net saw his wife naked =/ why did ppl browse in his phone anyway, even tho he shouldnt have left his phone ard its still quite rude... isnt it common sense that u dont just touch other ppl's personal belongings? anyway, sucha big fuzzzzz, id just sit in the corner n cry abt it hahahaha

Someone could have possibly looked through his phone before the employees could have secured it. Hate the tort laws in the US.
they so won't win, the sheer fact that he shouldn't have those pics on his phone in the first place and he lost his phone and is just using the mcdonalds staff as the bait. how can they promise secure something when it isn't theirs in the first place and it is just his word against mcdonalds so i don't think he will win. not rele a strong case. seems to be wasting time in court.
