I have a mock trial project to do at school and I need some help. I'm the accused who is accused of smuggling cocaine. I am a father of 3 teenagers with a six figure salary with an upcoming divorce which is causing me to have cash flow problems. I work for a Import Export company. After I come back from Colombia I bring back 3 bottles of liquor that are actually cocaine. I got the bottles of liquor from a potential supplier. He gives me the liquor as samples for my customers. Due to licensing agreements it would have to go to Colombia Imports for clearance. I get back to Toronto and I'm found to possess drugs. Now, I know I can win the case no matter what almost because they can't really prove that I knew of the cocaine. Now I need help forming some questions that will make me seem more credible by inciting the prosecution side to as questions that will make me look good. Any suggestions?
Hehe...I did mock trials in my legal studies class too, let me help you out a bit. Mitigating Factors: Well established employment Family Man High Income Prosecution will ask: You have the possession of the cocaine Cash flow problems which results in you having to earn another form of income
heh... this is usually my forte... but today, i cant think... once im able to think again, ill drop some lines...
hmmm interesting... I would say ur actually in a hole lol... You are a professional working for an Import Export company, but you don't know the potential problems of bringing stuff into the country, like cocaine in liquor bottles? You didn't inspect the bottles before you flew back? just some questions I would have atm...
hmmm... i was just thinking.. what are the grounds for which one can be charge of simple possession? i mean, there would not be enough evidence to try for smuggling and trafficking of drugs, which you can probably avoid, but what about possession of an illegal substance? the prosecution might gun for that point too..
point out that you dont need to do drugs. high salary and children. tell them that where you got it from. yeah same as before.
