The defendant is an idiot. She should get her ass kicked and she belongs in jail. That aside, Judge Judy should be ashamed in calling herself a judge. In this case, she fails to publicly and properly address the defendant's rationale, of "a photo only" and why it should not be considered an adequate defense against a charge of fraud. She did lightly broach the topic by detailing the ad's product description character (which talked about the weight of the phone) but she never discussed why that would legally support a charge of fraud, and why the "a photo only" clause in the ad is not considered adequate legal defense. Instead, she tangentially veered into the arena of bad parenting and began name calling that lowered her to the level of the defendant. First and foremost, a jurist is to remain impartial; even if a judge personally finds a defendant's behavior abhorrent, they must at least maintain a deportment supportive of justices' blindness concept of cases before the court. In this regard, she failed miserably. Of course, I do realize that this is only television. But, the fact remains, the sensationalism or what makes Judy so attractive to audiences, is exactly that which would cause cases to be retried (for breaches of impartiality). It's no wonder Judy is retired from the bench.

Disclaimer defense (especially when rendered in fine print where the bulk of the advertising boldly suggests something else*), have been shown to provide very little legal umbrage from charges of fraud. In this case, the ad obviously remains highly suggestive of cell phones being offered for sale. It is the classic bait and switch method of enticement selling, which is considered illegal in just about all states within the US. * In this case, Stub Antenna, Clamshell design, Battery Power etc., mentioned in the ad but barely or not even discussed by Judy.
all for television .. i am sure that's not how judge judy would act in reality whilst on the bench cuz she can be easily kicked off if she does that off the set. $400 for the photos .. very stupid defense.
